Terms of Service

1. Agreement to Terms

By accessing or using Backed ("the Platform", "we", "us", or "our"), operated by Phico, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Platform.

The Platform is operated from Spain and is subject to the laws of Spain and the European Union, including the General Data Protection Regulation (GDPR).

2. Eligibility

You must be at least 18 years old to use Backed. By using the Platform, you represent and warrant that you are at least 18 years of age.

3. About Backed

Backed is a trust-based professional reputation platform where collaborators write public, accountable recommendations called "Backs." Each Back is:

  • Public: Visible to everyone
  • Accountable: Author's identity is always shown
  • Immutable: Cannot be edited after submission
  • Honest: Positive, neutral, and negative Backs are allowed

4. User Accounts

4.1 Registration

To use certain features of the Platform, you must register for an account. You may register using:

  • Email address and one-time password (OTP)
  • Google OAuth authentication

4.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account at support@backed.page.

4.3 Profile Information

When creating a profile, you agree to provide accurate, current, and complete information. You may update your profile information at any time through your account settings.

5. Backs (Recommendations)

5.1 Creating Backs

When you create a Back for another user, you agree that:

  • The information you provide is truthful and based on your actual professional experience with the recipient
  • You may only Back the same person once every 30 days
  • Your Back will be publicly visible and attributed to you
  • Backs cannot be edited once submitted
  • You may delete your Back at any time

5.2 Receiving Backs

By having a profile on Backed, you understand that:

  • Other users may write Backs about you
  • Backs may be positive, neutral, or negative
  • You cannot edit or remove Backs written by others
  • You may report Backs that violate our content policies

5.3 Immutability

Once submitted, Backs cannot be edited by either the author or the recipient. This ensures authenticity and prevents manipulation of professional reputation. Authors may delete their Backs entirely, but editing is not permitted.

6. Prohibited Content and Conduct

You agree not to create, post, or share content or engage in conduct that:

  • Is false, misleading, or fraudulent
  • Infringes on intellectual property rights
  • Contains hate speech, harassment, or threats
  • Includes personal information of others without consent
  • Promotes illegal activities
  • Contains spam or unsolicited commercial content
  • Impersonates another person or entity
  • Contains malware, viruses, or harmful code
  • Violates any applicable law or regulation

7. Content Moderation

We reserve the right to review, monitor, and remove content that violates these Terms. Users may report inappropriate Backs or profiles through our reporting system. We will investigate reports and take appropriate action, which may include:

  • Removing the offending content
  • Issuing warnings to users
  • Suspending or terminating accounts

Appeals of moderation decisions may be submitted to moderation@backed.page.

8. Intellectual Property

8.1 Your Content

You retain ownership of all content you create on Backed, including your profile information and Backs. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Platform.

8.2 Platform Content

The Platform, including its design, features, and functionality, is owned by Phico and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through your account settings or by contacting us at support@backed.page. Upon deletion:

  • Your profile will be removed within 30 days
  • All your personal data will be permanently deleted within 30 days
  • Backs you have written will be anonymized or removed
  • Backs written about you will remain but be dissociated from your profile

9.2 Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or for any reason at our discretion. We will provide notice when reasonably possible.

10. Third-Party Services

The Platform uses third-party services, including:

  • Google Cloud: For hosting and data storage
  • Google Analytics: For usage analytics
  • Google OAuth: For authentication

Your use of these services is subject to their respective terms of service and privacy policies.

11. Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

12.1 No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 Accuracy of Information

We do not verify the accuracy of Backs or profile information. Users are solely responsible for the content they post. We make no representations or warranties regarding the accuracy, reliability, or completeness of any content on the Platform.

12.3 Professional Advice

Backed is a reputation platform, not a professional reference service. Information on the Platform should not be used as the sole basis for employment or business decisions.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHICO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Platform
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Platform
  • Any bugs, viruses, or other harmful code
  • Any content posted by other users

14. Indemnification

You agree to indemnify, defend, and hold harmless Phico from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Catalonia, Spain.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Phico regarding your use of the Platform.
